Portrait Services Agreement & Policies
At Jonathan Fanning Studio & Gallery, INC, we are committed to providing an exceptional client experience and maintaining the highest standards of service and artistry. Please review the following policies before booking or placing an order.
Booking & Retainers
A non-refundable retainer is required to reserve your session date and time. Your date is not officially booked until the retainer has been received.
Retainers are applied toward your total balance.
All payments made toward photography services, digital images, and custom products are non-refundable and all sales are final.
Rescheduling
We understand that life happens. One session may be rescheduled without penalty if requested at least 48 hours before your scheduled session time.

If calling and there is no answer, please leave a voicemail for your notice to be considered valid.
Rescheduling requests are subject to studio availability. Requests made less than 48 hours before the session may result in forfeiture of the retainer.
Sessions should be rescheduled and completed within 30 days of the original date whenever possible.
Additional rescheduling requests may require a new retainer or full payment before booking another date.
Cancellations
If a session is canceled, all monies paid will be retained by the Studio.
Late Arrivals & No-Shows
Please arrive on time so you can enjoy your full session experience.
Sessions will still end at the originally scheduled time if a client arrives late. Late arrival time will be deducted from the reserved session time.
Clients arriving more than 30 minutes late may be considered a no-show at the Studio’s discretion.
Missed appointments without notice will result in forfeiture of all monies paid.
If additional time is available and requested, session extensions may be added for an additional fee.
Digital Images
All digital image purchases are final and non-refundable.
Once digital images have been delivered or downloaded, they are considered accepted by the client.
The Studio does not provide RAW or unedited files.
Clients are responsible for downloading, backing up, and safely storing their final images after delivery. Final galleries are archived for up to one (1) year from the session date, but long-term storage is not guaranteed.
While the Studio maintains professional backup systems, the Studio is not responsible for loss caused by technological issues, accidental deletion, equipment failure, or unforeseen catastrophic events.
Reshoots & Image Selection
To help create the best possible results, clients are encouraged to arrive camera-ready and prepared for their session.
Clients may request pose adjustments or retakes during their scheduled session time whenever time allows.
Requests for additional sessions or reshoots related to hair, makeup, wardrobe, styling concerns, or changes in creative preference after the session has ended may require an additional reshoot fee.
Please carefully review all images before making final selections. Once image selections are approved, recreating or replacing images at a later date may require booking a new session.
Custom Products (Albums, Prints & Books)
All printed products, albums, books, and wall art are custom-made and non-refundable.
Replacements are available for:
- Manufacturer defects
- Shipping damage reported within 48 hours
- Studio fulfillment errors
Client approval is required before any product goes into production.
Pricing is subject to change at any time. Orders placed more than 30 days after the session date may be subject to current pricing.
Payments & Late Fees
- A minimum 50% non-refundable retainer is required for printed products
- Remaining balances must be paid before production or shipping
- Digital images and galleries will not be delivered until payment has been received in full
Balances unpaid after 30 days may incur a 1.5% monthly late fee.
Orders with outstanding balances will remain on hold until payment is completed.
Proofing & Approvals
Image selections and product approvals should be completed within 30 days whenever possible.
All approvals must be submitted in writing. Verbal approvals are not accepted.
Once a product or design has been approved, clients assume responsibility for spelling, layout, image choices, and design details.
After final approval, additional edits, revisions, or redesigns may incur additional fees.
Please note that color variations between screens and printed products are normal and are not considered defects.
Artistic Style
By booking with Jonathan Fanning Studio & Gallery, INC, clients acknowledge that they are familiar with and appreciate the Studio’s editing and artistic style.
While every effort is made to capture a variety of beautiful images, specific poses, expressions, backgrounds, or image counts cannot be guaranteed.
Additional retouching requests beyond standard editing may incur additional fees.
Weather Policy
Outdoor sessions may occasionally need to be rescheduled due to unsafe weather conditions.
Weather decisions are typically made within two hours of the scheduled session time, although earlier decisions may be made when necessary.
If the Studio reschedules due to weather, there is no penalty to the client.
Once a session has started, it is considered completed for scheduling and refund purposes.
Client Responsibility
Timely communication, image selections, approvals, and payments help ensure a smooth experience and timely delivery of products.
The Studio is not responsible for delays caused by lack of communication, delayed approvals, missed deadlines, or unpaid balances.
File Retention
Final edited images are archived for up to one (1) year after delivery.
After that time, files may be permanently removed from storage without notice.
Clients are encouraged to download and back up their files immediately after delivery.
Client Conduct
The Studio reserves the right to end a session without refund if unsafe, abusive, threatening, or disruptive behavior occurs during the session.
Associate Photographer
In rare cases involving illness, emergencies, or scheduling conflict arising from incorrect or miscommunicated client-provided date., the Studio may assign a qualified associate photographer to fulfill the session. No refunds will be issued in such cases.
Shipping
Clients are responsible for shipping and handling costs for physical products.
Once products are delivered to the shipping carrier, the Studio is not responsible for shipping delays, loss, theft, or damage during transit.
Model Release
Unless otherwise requested in writing, the Studio may use images from sessions for portfolio display, website content, social media, marketing, advertising, and promotional purposes.
Clients may opt out by submitting a written request before or at the time of booking.
Parents or legal guardians confirm they have authority to consent for any minors participating in the session.
Copyright & Personal Use
All images created by Jonathan Fanning Studio & Gallery, INC remain copyrighted property of the Studio.
When digital images are purchased, clients receive a personal-use license to download, print, and share their images for non-commercial purposes.
Images may not be sold, altered for commercial use, submitted for publication, entered into contests, or used for advertising without written permission from the Studio.
Commercial licensing is available separately upon request.
AI Use & Image Protection
Images created by the Studio may not be used for:
- AI training
- Facial recognition systems
- Synthetic media creation
- AI image manipulation or reconstruction
Clients may not upload Studio images to AI platforms that store, analyze, or train on uploaded content.
Unauthorized AI use of Studio images without written permission is prohibited.
Liability
The Studio’s liability is limited to the amount paid for the services provided.
Governing Law
These policies and services are governed by the laws of the State of Florida.
Agreement
By booking a session or purchasing products or services from Jonathan Fanning Studio & Gallery, INC, clients acknowledge that they have read, understood, and agreed to these policies.
